Delhi High Court Issues Injunction Against YouTube Channel Linked to Vivek Bindra in Sandeep Maheshwari Defamation Case



In a significant legal development, the Delhi High Court has granted an injunction against Vikash Kotnala, a YouTube channel partner of entrepreneur Vivek Bindra, restraining him from posting defamatory or disparaging material against YouTuber and motivational speaker Sandeep Maheshwari. Justice Prateek Jalan found a prima facie link between Kotnala and Bindra and noted violations of a civil court order from December 22, 2023, which restrained both Maheshwari and Bindra from making defamatory statements against each other.

Background and Legal Battle


The legal battle originated from a video released by Sandeep Maheshwari on December 11, 2023, titled ‘Big Scam Exposed,’ where he alleged Bindra's involvement in a scam related to a 10-day MBA course. The civil court in Faridabad had previously restrained both Maheshwari and Bindra from making defamatory allegations against each other.

Court's Observations on Deteriorating Discourse

During the court proceedings, Justice Jalan commented on the declining discourse on social media, describing it as "some sort of war that is starting on these YouTube channels." The court expressed concern over the low level of discourse in the ongoing rivalry between the two influencers.

Prima Facie Case and Injunction Order

Senior Advocate Sandeep Sethi, representing Sandeep Maheshwari, argued that Kotnala was influenced by Bindra to make allegations against Maheshwari. 

Reference was made to videos where Kotnala accused Maheshwari of attempting to extort money from Bindra and orchestrating a campaign against Bindra in the market. The court concluded that Maheshwari presented a prima facie case, and to prevent irreparable harm, an injunction order was issued against Kotnala, restraining him from publishing defamatory material against Maheshwari online or offline.

This legal development adds a new dimension to the ongoing conflict between Maheshwari and Bindra, both influential figures with massive social media followings.
